A former federal prosecutor, Jonathan Fahey, has suggested that Representative Alexandria Ocasio-Cortez (D-N.Y.) may be close to breaking federal law by advising illegal immigrants on avoiding Immigration and Customs Enforcement (ICE) detentions. Fahey warned that her actions could constitute obstruction of justice, a serious charge.

Ocasio-Cortez has hosted webinars and distributed materials informing illegal immigrants of their rights, including advice on handling ICE encounters. Critics, including former Trump border czar Tom Homan, argue that this guidance could interfere with law enforcement. Homan has requested a Justice Department review to determine if legal action should be taken.

Supporters claim her efforts are about ensuring individuals understand their rights, while opponents argue she may be facilitating defiance of federal law. As the DOJ reviews the matter, the debate highlights the ongoing tension over U.S. immigration policies.
